Poulin | Willey Trial Lawyers (“PW,” “we,” “us,” or “our”) is committed to protecting your privacy. This Privacy Policy explains how we collect, use, disclose, and protect information when you visit a PW website or landing page that links to this Privacy Policy, communicate with us, submit information regarding a potential legal matter, or otherwise use our services. It also describes our practices relating to SMS/MMS and RCS communications.
By using a website or service covered by this Privacy Policy, you acknowledge the practices described below. Where applicable law requires affirmative consent for a particular collection, use, disclosure, or communication, PW will seek that consent separately as required. This Privacy Policy should be read together with the applicable Terms of Use and Legal Notices.
Information We Collect
We may collect information automatically when you visit our websites, including your Internet Protocol (IP) address, domain information, browser type, operating system, device information, referring website or source, pages viewed, links clicked, dates and times of access, and other information concerning your interaction with our websites.
We also collect information that you voluntarily provide to us when you communicate with PW or submit information through a website form, telephone call, text message, email, chat, document upload, or other communication. Depending on the nature of your inquiry or legal matter, this may include:
- name, mailing address, email address, telephone number, and other contact information;
- information concerning an accident, injury, medical treatment, potential claim, legal matter, or other circumstances about which you contact us;
- documents, photographs, recordings, correspondence, or other materials you choose to provide;
- information necessary to evaluate a potential matter, provide legal services, communicate case updates, schedule appointments, request documents, or otherwise respond to you; and
- communications and other information generated through your interactions with PW.
Information you provide regarding a potential legal matter may include sensitive personal information. Please provide only information reasonably necessary for PW to evaluate or respond to your inquiry.
How We Use Information
PW may use information we collect to:
- respond to inquiries and evaluate potential legal matters;
- provide legal services to clients and administer attorney-client relationships;
- communicate with prospective clients, clients, and others concerning inquiries or legal matters;
- provide intake follow-ups, case updates, appointment reminders, document requests, and other service-related communications;
- operate, maintain, secure, troubleshoot, analyze, and improve our websites, services, intake systems, and communications;
- maintain records, conduct training and quality assurance, and improve client service;
- detect, investigate, and prevent fraud, misuse, security incidents, or unlawful activity;
- comply with applicable laws, court orders, legal process, professional obligations, and regulatory requirements; and
- protect the rights, property, safety, and legitimate interests of PW, our clients, website users, and others.
Where permitted by law, we may also use contact information to provide information about PW, legal developments, firm news, or services that may be relevant to you. You may opt out of promotional email communications using the unsubscribe mechanism provided in those communications, where applicable.
SMS/MMS and RCS Messaging
When you provide your mobile number and opt in to receive SMS/MMS or RCS messages from PW, you consent to receive messages related to your inquiry or legal matter. Messages may include:
- case-evaluation confirmations and intake follow-ups;
- status updates regarding your legal matter;
- appointment scheduling and reminders;
- document or information requests;
- case-related reminders and communications; and
- responses to messages you send to PW.
Consent to receive text messages is not a condition of retaining PW or using our websites or services.
Message Frequency
Message frequency varies depending on your inquiry, case activity, and communication needs. You may receive more or fewer messages at different stages of an inquiry or legal matter.
Message and Data Rates
PW does not charge a separate fee to receive its SMS/MMS or RCS communications. However, standard message and data rates or other charges imposed by your wireless carrier may apply. Carrier rates and terms are determined by your provider and plan.
Opting Out of Text Messages
You may opt out of SMS/MMS or RCS messaging at any time by replying STOP to a message from PW. After processing your opt-out request, you will no longer receive messages through that messaging program except for communications permitted by applicable law, such as a confirmation of your opt-out. Opting out of text messages does not prevent PW from communicating with you through other lawful channels when appropriate.
Getting Help With Text Messages
For assistance with PW text messaging, reply HELP to a message from PW. You may also contact PW at 800-777-7777 or info@poulinwilley.com.
Mobile Information and Messaging Consent
PW does not sell your mobile number, SMS/MMS or RCS opt-in data, messaging consent information, or messaging-originator data. We do not share or otherwise provide such information to third parties or affiliates for their own marketing or promotional purposes.
We may provide mobile information and messaging-consent data to vendors and service providers that assist us in delivering, routing, supporting, securing, or administering our communications, but only as reasonably necessary to provide those services or as otherwise permitted or required by law.
Cookies and Similar Technologies
We may use cookies and similar technologies on our websites. A cookie is a small data file stored on a visitor’s browser or device that can help a website operate, remember preferences, understand website usage, identify repeat visits, measure performance, and improve the user experience.
We and service providers acting on our behalf may use cookies or similar technologies to understand how visitors arrive at and interact with our websites, measure the effectiveness of website content or advertising, prevent fraud, and improve our services. Depending on your browser or device, you may be able to block, delete, or limit cookies through your settings. Disabling cookies may affect the functionality of portions of our websites.
Analytics, Advertising, and Online Technologies
PW may use third-party analytics, advertising, call-tracking, website-performance, or similar service providers, and technologies such as cookies, pixels, tags, conversion-measurement tools, and similar technologies, to help us understand website traffic, measure the effectiveness of our advertising, improve our services, and understand how users interact with our websites. These providers may receive device, browser, IP address, cookie, referral, interaction, or similar technical information as necessary to provide their services.
PW does not authorize these providers to receive confidential attorney-client communications merely for advertising purposes. Information collected through online technologies is subject to this Privacy Policy, applicable law, and the terms governing the applicable provider.
How We Disclose Information
PW does not sell personal information for money. Some state privacy laws define terms such as “sale,” “sharing,” or “targeted advertising” more broadly and may treat certain advertising or analytics disclosures as regulated activity even when no money is exchanged. Where such laws apply, PW will provide and honor applicable privacy choices as required by law. We may otherwise disclose personal information when reasonably necessary for the purposes described in this Privacy Policy, including to:
- attorneys, law firms, co-counsel, local counsel, referral counsel, experts, investigators, litigation vendors, medical-record vendors, and other persons or entities involved in evaluating or handling a potential or accepted legal matter, where appropriate and permitted by law;
- vendors and service providers that support our websites, intake operations, communications, hosting, data storage, security, analytics, case-management systems, document handling, or other business functions;
- government authorities, courts, regulators, law enforcement, or other persons when required by law, subpoena, court order, legal process, or applicable professional obligations;
- persons or entities when we reasonably believe disclosure is necessary to investigate unlawful activity, prevent fraud or security threats, enforce our rights, protect property or safety, or respond to misuse of our websites or services; and
- a successor or other appropriate party in connection with a merger, reorganization, transfer, or other change involving some or all of PW’s operations, subject to applicable attorney-client privilege, confidentiality obligations, professional-conduct rules, client-consent requirements, and other applicable law.
Submission of information concerning a potential legal matter does not by itself create an attorney-client relationship. Where PW refers, associates, or works with another law firm concerning a potential or accepted matter, information may be provided to that firm as permitted by law and consistent with applicable professional obligations.
Data Security
PW uses reasonable administrative, technical, and physical safeguards designed to protect personal information against unauthorized access, use, alteration, disclosure, or destruction. These safeguards may include encryption, access controls, secure systems, authentication measures, employee access limitations, and other security practices appropriate to the nature of the information.
No Internet transmission, electronic communication, or information-storage system can be guaranteed to be completely secure. Accordingly, PW cannot guarantee the absolute security of information transmitted to or maintained by us.
Retention of Information
PW may retain personal information for as long as reasonably necessary to evaluate inquiries, provide legal services, maintain business and legal records, comply with professional obligations, resolve disputes, enforce agreements, satisfy legal or regulatory requirements, and protect PW and its clients. Retention periods may vary depending on the type of information and the purpose for which it was collected.
Links to Other Websites
Our websites may contain links to websites or services operated by third parties. PW is not responsible for the content, security, or privacy practices of third-party websites. We encourage you to review the privacy policy of any third-party website or service you visit.
Publicly Disclosed Information
If you voluntarily disclose personal information in a publicly accessible area of the Internet, including public discussion boards, social-media pages, comments, or other public forums, that information may be collected and used by others. PW cannot control information you choose to make publicly available outside of PW-controlled private communications.
Surveys, Promotions, and Contests
From time to time, PW may request information through surveys, promotions, or contests. Participation is voluntary. Information requested may include contact information and demographic information. If applicable, contact information may be used to administer the promotion, notify participants, or award prizes, while survey information may be used to understand and improve our websites, communications, or services.
Children’s Privacy
PW’s websites and services are not directed to children for the purpose of collecting personal information from them independently. A parent, guardian, or other authorized adult may contact PW concerning a legal matter involving a minor. If we learn that personal information has been submitted by a child in circumstances where applicable law requires parental consent or other action, we will address the information as required by law.
State Privacy Rights
Depending on where you reside and whether a particular privacy law applies to PW or to the information at issue, you may have rights concerning your personal information, which can include rights to request access, correction, deletion, or information concerning certain disclosures or uses. These rights are subject to exceptions and limitations under applicable law, including obligations relating to legal services, attorney-client privilege, attorney work product, litigation, professional responsibility, record retention, and other legal requirements.
To submit a privacy request, contact info@poulinwilley.com. We may need to verify your identity and authority before processing a request. PW will respond to applicable requests as required by law.
California Privacy Requests
To the extent California privacy law applies to PW and provides you with a right to request information concerning your personal information or certain disclosures, you may submit a request to info@poulinwilley.com. Any applicable request will be processed in accordance with governing law, including applicable exceptions for legal services and privileged or protected information.
Sensitive Personal Information and Information About Potential Legal Matters
Because PW evaluates and represents individuals in connection with personal injury and other legal matters, information you voluntarily provide to us may include sensitive personal information. Depending on the circumstances, this may include information concerning injuries, medical conditions and treatment, health insurance, accidents, employment, finances, government-issued identification, photographs or recordings, family members, witnesses, insurance claims, and other information relevant to a potential or existing legal matter.
PW uses sensitive personal information only for purposes reasonably related to evaluating potential legal matters, providing legal services, communicating with prospective or existing clients, administering our operations, preventing fraud or security incidents, complying with legal and professional obligations, and other purposes permitted by applicable law.
PW does not use the substance of confidential attorney-client communications or information submitted to us concerning the facts of a potential or existing legal matter for unrelated targeted advertising. We do not intentionally provide confidential case details, medical information submitted for case evaluation, or privileged attorney-client communications to advertising platforms for their own advertising purposes.
Call Recording and Communications
Telephone calls to or from PW may be recorded or monitored for intake, documentation, training, quality assurance, compliance, security, and service-improvement purposes, subject to applicable law. We may retain recordings and information derived from those communications as reasonably necessary for these purposes, to evaluate or handle legal matters, or to satisfy legal and professional obligations.
PW may communicate with you by telephone, email, text message, or other communication methods you provide or authorize. Service-related communications may include responses to inquiries, intake follow-ups, appointment reminders, document requests, and communications concerning a potential or existing legal matter.
Where permitted by law, PW may separately send newsletters, firm information, legal updates, or other marketing communications by email. You may unsubscribe from marketing emails using the unsubscribe instructions included in those messages. Opting out of marketing communications does not prevent PW from sending communications necessary to respond to your inquiry or service an existing attorney-client relationship.
Referrals, Co-Counsel, and Other Law Firms
PW provides legal services only where its attorneys are licensed, admitted, or otherwise authorized to practice and may work with, associate, or refer matters to other qualified lawyers or law firms where appropriate. If you contact PW concerning a potential legal matter, we may provide information you submitted to another lawyer or law firm for purposes of evaluating, referring, associating on, or handling your potential claim.
Providing information to another law firm for these purposes is different from selling personal information for unrelated commercial marketing. PW does not authorize a law firm receiving information for case evaluation, referral, association, or representation to use that information for unrelated third-party marketing.
If you become a PW client, disclosures and transfers of information relating to your representation remain subject to applicable attorney-client confidentiality requirements, professional-responsibility rules, privilege protections, engagement agreements, and applicable law.
State Privacy Choices and Browser Signals
Depending on your state of residence and the applicability of state privacy law, you may have rights concerning access to, correction of, deletion of, or portability of certain personal information, as well as rights concerning certain forms of targeted advertising, profiling, sale, or sharing of personal information. Applicable rights and exceptions vary by jurisdiction.
Where required by applicable law, PW will recognize legally valid browser-based opt-out preference signals, such as Global Privacy Control, for the browser or device from which the signal is sent. PW may also provide other mechanisms for exercising applicable privacy choices.
Where applicable law provides a right to appeal PW’s decision concerning a privacy request, you may submit an appeal by contacting info@poulinwilley.com and identifying the request and decision you wish to appeal. PW may take reasonable steps to verify your identity or the authority of an authorized agent before processing a privacy request.
Nothing in this section requires PW to disclose, delete, alter, or otherwise process information where an exception applies, including information protected by attorney-client privilege, attorney work product, professional confidentiality obligations, litigation-related protections, legal holds, record-retention obligations, or other applicable law.
Changes to This Privacy Policy
PW may update this Privacy Policy from time to time to reflect changes in our practices, technologies, services, legal requirements, or other circumstances. When we make changes, we will post the revised Privacy Policy on the applicable website and update the ‘Last updated’ date. Your continued use of a website or service after an updated policy is posted is subject to the revised policy to the extent permitted by law.
